WHAT IS SANCTUARY?
But Boaz answered her, “All that you have done for your mother-in-law ... how you left your father and mother and your native land and came to a people that you did not know before. May the Lord reward you for your deeds, and may you have a full reward from the Lord, the God of Israel, under whose wings you have come for refuge!’
Throughout history, the people of God have provided safe space in their places of worship for those vulnerable under the laws and customs of the time. The Hebrew people had cities of refuge for persons wrongfully accused of crimes. In the years before the American Civil War, congregations provided safety for slaves fleeing the South in the Underground Railroad. In the 1980s, more than 500 U.S. congregations provided safe houses to Central Americans fleeing civil war but whom our government refused to acknowledge as refugees.
Today churches are providing sanctuary to people with final orders of deportation. Law-abiding parents and workers caught in the clutches of a broken immigration system are entering houses of worship to fight their orders of deportation from a safe space. Congregations are standing with families at risk of separation.
WHY SANCTUARY AND WHY NOW?
Eleven million undocumented persons are living in the United States, the majority of whom have lived here for more than ten years. They are our friends, neighbors, and family members.
All are at risk of deportation.
Year after year, Congress refuses to pass immigration reform. The president attempted to bring relief in November of 2014 with expanded Deferred Action for Childhood Arrivals and the creation of a program that would defer the deportation of Parents of Americans, but both of those programs are on hold while a court decides if the administration has authority to implement them. Meanwhile, the U.S. continues to fund an 18 billion dollar a year immigration enforcement system that continues to deport persons with significant ties in the U.S. The film Journeying in Hope, captures the strife felt by families and ministries on the border that are offering witness and support in the midst of this crisis.
Many church communities refuse to sit by and watch another family torn apart. Congregations are standing alongside members of their church and community by hosting legal clinics, writing letters of support to judges and immigration officers, and accompanying those in deportation proceedings. These acts of solidarity are, sometimes, enough to stop unjust deportations. When they are not, some bodies of faith are offering sanctuary.

Legal Issues related to Sanctuary
DECIDING TO OFFER SANCTUARY OR TO SUPPORT SANCTUARY
The decision to offer sanctuary should not be taken lightly. Some cases are right for sanctuary and some are not. The social witness of sanctuary is only powerful if it matches the strategy of the person with the order of deportation. It is important that you have a good relationship with the person entering sanctuary and that person’s attorney so you can decide together and with all the right information. The Reverend Alison Harrington of Southside Presbyterian Church has created a guide about sanctuary (PDF) that will be useful to sessions considering sanctuary.
In addition to weighing whether to support sanctuary, here are two other things to consider:
Is sanctuary legal?
This is a question a session needs to discuss thoroughly with an attorney before a church offers sanctuary. Congregations that offer sanctuary can certainly be charged with the crime of harboring, but could they be convicted? While the congregations offering sanctuary today are not bringing individuals into the country, there is a question of whether they are harboring. The law forbids the act of harboring someone in a building who is known to be remaining in the U.S. in violation of the law. Some courts have held that harboring requires that the person being charged actually hide the person remaining in violation of the law. If harboring does require hiding or concealing a person, these churches are not in violation because they are all publicly calling on the government to rectify the final order of deportation of the person living in sanctuary. Unfortunately, there is also case law that defines the act of harboring as providing shelter. If simple shelter with no concealment is harboring, then all the churches offering sanctuary and any family member or friend with an undocumented person within their household is in violation of the harboring statute. While we pray this is not the case, both decisions with their conflicting definitions need to be considered.
In addition to or instead of offering sanctuary within the church, how can communities of faith participate?
Sanctuary is not just about living within the protection of the walls of a congregation, it is about living in the shelter of a community of faith that is working alongside the “Sanctuary Church” to keep a family together. In order to strengthen the witness of the “Sanctuary Church” other communities of faith become part of the shelter and protection of the family by: participating or leading prayer vigils, phone banking, writing letters, circulating petitions, staying over night with the family, donating money to the church and the family, visiting with them, bringing them meals/food, and doing anything we can to let them know that they are not alone. In short, there is a role for everyone to play, even if you find that your congregation will not be able to declare Sanctuary. So remember, when a congregation offers sanctuary to a family it is not the building that protects the family, it is the community that protects the family; it is within the love and support of the community that the family finds shelter and each and everyone of us is part of that community. - From Sanctuary an Overview (2014)

Draft Motion to be Presented at January Session Meeting of New York Avenue Pres:
Move that NYAPC take the following actions:
1) Join over 400 congregations and over 4000 individuals in making the following public pledge:
As people of faith and people of conscience, we pledge to resist the newly elected administration’s policy proposals to target and deport millions of undocumented immigrants and discriminate against marginalized communities. We will open up our congregations and communities as sanctuary spaces for those targeted by hate, and work alongside our friends, families, and neighbors to ensure the dignity and human rights of all people.
This pledge affirms NYAPC’s place as a part of the “Sanctuary” movement, which the task force believes is consistent with the church’s mission to be an inclusive, justice-seeking presence in Washington, DC and the world. However, the signing of the pledge does not commit the church to physically housing individuals or families. The Task Force recommends deferring any decision on a public grant of sanctuary to a particular individual/family until if and when an individual/family has been identified.
2) Hang a banner outside of the church that affirms our commitment to welcoming immigrants and refugees. Task the Sanctuary Task Force with creating a mock-up of the banner and presenting it to the session for final approval (with details as to proposed placement).
The Task Force proposes a banner with the words “Immigrants and Refugees Welcome” in English and other languages (including potentially Spanish, Arabic, French, and Vietnamese), on top of a Mary/Joseph/Christmas scene. Graphic design resources have already been identified to assist.
3) Task the Sanctuary Task Force with developing and implementing specific steps through which NYAPC can fulfill its pledge to be a “Sanctuary congregation.” Initial ideas from the Task Force include:
-Creating a list of immigration service providers that can be provided to interested individuals
-Scheduling and publicizing an “immigration services day” on a weekend afternoon at the church to attempt to connect families in need to legal, social work, and other relevant service providers
-Identifying individual members interested in “Sanctuary”-related mission work, which could include individual volunteer work (e.g., pro bono legal, social work, or other services) or participation in larger “Sanctuary” efforts/activism led by the PC(USA) Office of Public Witness, Washington Interfaith Network, or other organizations
-Informing immigration service providers of the church’s willingness to consider providing “sanctuary” to an individual or family, and developing a recommendation for way(s) in which the church might do so (e.g., physically housing a family vs. providing a family with resources or identifying external housing). The Task Force would return to the Session with a specific proposal before any further action is taken.
